I guarantee that is the reason. Its like he has to cover those mares + a book that is already huge. His first year at stud he only covered 61 mares, which resulted in 46 live foals, I would imagine part were owned by Spendthrift but even if 40 were free lifetime rights, that's an additional 40 mares he covers every year that they don't make money on. So of course they want to keep his books huge. It could take away 1/3 of his possible book. I understand Spendthrift are likely trying to make up for those shareholders, but in the long run I’m sure it’ll be better for Into Mischief.

Only a handful of lifetime breeding rights to Into Mischief were awarded as a result of the Share the Upside program. First of all, Spendthift lets a very limited number of breeders participate in the program for each new stallion (certainly not 40). Then they each have to fulfill the terms of the deal. So if one of the mares you breed in the specified year aborts, doesn't conceive, or delivers a dead foal, you've missed your chance. Don't forget too, that IM wasn't initially considered to be a great stallion prospect when he started at stud. Breeders weren't beating down the doors to get to him then.
